This policy applies to the use and communication of any information collected, as well as to how Ekosystem and its subsidiaries collect said information in the context of your business relationship with them. This policy applies as long as we hold your information, including after the end of our business relationship. Our Chief of Personal Information Protection and Privacy is responsible for these practices within Ekosystem and its subsidiaries. This Privacy Policy applies to Ekosystem and its subsidiaries offering recruitment, consulting, and RPO services.

We may also collect your information indirectly and from other sources. When required, we obtain your consent.

What is a cookie?

A cookie is a text file stored by your browser in a dedicated space on your device’s hard drive when you visit a website. It allows the sender to identify the device it is placed on during its validity period and remember certain information related to your journey, such as simplifying your browsing on websites or offering you content tailored to your interests.

Purposes of Data Processing

We and our partners use technologies that collect non-critical information from your device to improve our offerings and present advertisements and content adapted to your preferences. You have the choice to accept or reject certain purposes.

Essential and Security:
We use technologies and cookies that are essential to ensure the optimal functioning and security of our online services. Their deactivation is not possible. They help us, as well as our partners, secure your connection by recording your login details, adapting your interface (e.g., language preference), reducing fraudulent form submissions, and remembering your preferences related to the use of technologies that collect your information.

The data collected by these technologies plays a crucial role in continuously enhancing your browsing experience. They help us, as well as our partners, understand how you interact with our online services (e.g., your origin and browsing path) and evaluate and analyze the traffic on our platforms by generating statistics and data on audience (such as the pages viewed). Marketing and Advertising:
The data we collect helps us, as well as our partners, remember the links you click on and the pages you visit on our online platforms. This allows us to better understand your preferences and suggest offers and services tailored to your needs. It also facilitates the creation of target groups, i.e., sets of users with similar interests, to personalize our advertising campaigns and assess their impact more effectively. How to Manage and Disable Cookies?

  • Establish, manage, administer, and maintain the requested products and services.

  • Combine the information that Ekosystem or its subsidiaries hold about you to generate a 360° view of the products and services you benefit from, thus serving you better (see your right to refuse in Section 5.2).

  • Conduct studies and data analyses to generate statistics, improve our products and services, and design new ones, especially by analyzing the information collected through our website (see your right to refuse in Section 5.2).

  • Personalize your customer experience, including by analyzing your profile, purchases, and services you benefit from, as well as other information (including data collected through our website), to:

  • Better understand you and your needs.

  • Target and personalize products, services, and promotions that may interest you and fit your situation.

  • Offer you better advice by analyzing your needs and preferences.

  • Promote products and services that may interest you, offered by Ekosystem, its subsidiaries, or some of its partners, including personalized ads on social media and digital platforms (see your right to refuse in Section 5.2).

  • Inform you about new features available on our platform.

  • Carry out our routine business and operations.

  • Determine your eligibility for incentives (bundles, discounts).

  • Allow due diligence checks of our operations in anticipation of a commercial transaction.

  • Manage business risks and comply with laws and regulations.

  • Communicate with you using the contact information you provided (by post, email, text message, phone calls, social media, or others).

  • Use and communicate certain information in cases where the law allows us to do so (see Section 4).

  • 3.2. Communication of Your Information

  • Communicating your information to others for legitimate purposes is sometimes necessary. For example, it may be a mandatory communication under the law, necessary to protect your interests in case of fraud, or allow you to participate in a program with a partner or offer you services on our behalf. At all times, we are committed to limiting the information to what is strictly necessary and obtaining your consent when required.

  • We ensure the integrity, security, and confidentiality of your information. Under no circumstances will we sell customer lists to third parties.

  • We may communicate your information to:

  • Ekosystem and its subsidiaries, for information necessary to identify you, for compliance, and to simplify the management of your Ekosystem accounts.

  • A person acting on your behalf or at your request, e.g., a colleague.

  • A merchant, partner with whom we do business to offer optional products and services, a payment system, a card payment network, a compensation or settlement system.

  • Third parties if we need to disclose your information in judicial proceedings.

  • A regulatory or government authority or a self-regulatory organization.

  • A person authorized to obtain the information by law.

  • Third parties involved in concluding a commercial transaction.

  • Social media and digital platforms with which we may share your name and contact details (e.g., your email address) to enable us to display targeted ads on their platforms (see your right to refuse in Section 5.2).

  • As described below, service providers we engage to perform certain tasks.

 

3.3. Service Providers

We carefully select our service providers. They belong to the following categories:

  • Technology services (applications, data centers, data storage and backup, hosting services, maintenance and support services)

  • Professional services

  • Banking operations services

  • Communication services

  • Analytics and marketing services

The providers who have access to your information agree to use it only for the purposes outlined in the agreement and to ensure the same level of protection we provide.

4. CONSENT

By accepting this policy, you expressly agree to the processing practices (collection, use, communication, etc.) mentioned herein, according to your specific choices regarding the protection of your personal information, subject to the specific consents you may not want to give or have withdrawn in accordance with this policy. Moreover, by accepting this policy, you expressly declare:

  • That you are at least 14 years old if you reside in Canada and that you are of legal age to consent to the processing of your personal information in the jurisdiction where you reside (16 years old for the European Economic Area and the United Kingdom);

  • That you are the parent or legal guardian of a minor child and that you have expressly consented to the processing of that minor's personal information as described in this policy.

We do not wish to process personal information from minors unless we have received prior parental consent. If we become aware that we are processing personal information of a minor without such consent, we will take necessary measures to delete such personal information as soon as possible. We will process your personal information solely on the contractual basis of providing the service and in accordance with this policy.

We use your information only with your consent or if permitted by law. We obtain your consent for the collection, use, and communication of your information:

  • When you avail of a product or service, either as a buyer or a beneficiary of a new product or service.

  • When we need to use your information for a purpose different from the ones for which you have already given consent.

  • During specific interactions with us, such as customer service calls or filling out online forms.

However, we do not obtain your consent at each interaction. For example, if you are a subscriber to a magazine, we may consider that you agree for us to communicate with you for a satisfaction survey.

5. EXERCISING YOUR RIGHTS

5.1. Right to Accept or Refuse to Provide Your Information

Your information belongs to you. Subject to legal, commercial, or contractual requirements, you have the right to withdraw your consent for the collection, use, or communication of information. We will process your request as quickly as possible.

However, some information is essential for us to provide certain products and services. If you refuse to provide this information, it may be difficult, if not impossible, to establish or maintain a business relationship with you or to offer you some of our products. For example, if you do not provide your email address, we cannot send you newsletters, magazines, or other communications you have signed up for.

5.2. Right to Refuse the Use of Your Information for Certain Purposes

You may refuse that we use your information or withdraw your consent for the following purposes:

a) Sending you promotional offers

Ekosystem and its subsidiaries may, from time to time, share promotions with you that might interest you. You can withdraw your consent to receive them at any time. There may be a delay before you stop receiving our promotional offers, especially those part of an ongoing campaign.

We may also use your name, email address, or other contact details to create custom audiences on social media and digital platforms. This allows us to display ads tailored to your needs and interests on those platforms. You can refuse the use of your information for targeted ads by modifying your preferences in your social media account settings or by contacting us.

We may, from time to time, contact you to ask if you wish to update your preferences to ensure our records are up-to-date and reflect your current choices.

Please note that if you withdraw your consent to this use, you may still see some of our ads on social media platforms. However, these ads will not have been targeted based on the use of your name and contact details.

b) Collecting and using your digital information on our online services

With your consent, Ekosystem and its subsidiaries may use cookies, web beacons, pixels, log files, or other technologies to gather certain personal information about visitors to our website and recipients of our newsletters, invitations, and other communications. Cookies are data sent from the server to the browser when visiting a website, allowing the session to be uniquely identified. This information may include details like your IP address, browser type and version, the pages you visit on our site, the date and time of your visit, the length of your session, and other statistics.

Please note that our website may contain links to third-party sites. Our Privacy Policy no longer applies once you leave our site. Ekosystem and its subsidiaries are not responsible for the collection or processing of personal information by these third parties or via these external sites.

 

5.3 Withdrawal of Consent

You may withdraw your consent at any time to receive our promotional offers and to share your financial information between Ekosystem and its subsidiaries. You can make this request via your online Ekosystem account (by unsubscribing from newsletters or deactivating your account) or by contacting customer service. We will process your request promptly.

You may also refuse the use of cookies on our websites at any time.

What You Will Continue to Receive After Withdrawing Your Consent

You will continue to receive information related to your current products and services. You may also continue to receive information about our products and services in person from our team members. They are obligated to advise you and will continue to provide this information when necessary.

You may also continue to see personalized offers for our products and services on our website or on social media platforms if you have allowed the use of cookies and other similar technologies via our online banner.

5.4 Right to Access Your Information

You may request to view the information we hold about you, except in cases where the law imposes limits on such requests.

How to Access Your Information

To access your information, you must make a request:

  • Via your online Ekosystem account

  • By email, contacting our customer service

  • By live chat on the website with our customer service

  • By phone, contacting our customer service

We will process your request within 30 days or a longer period if required by law, and we will send you a confirmation by email. We will inform you if the processing time exceeds 30 days.

5.5 Right to Correct Your Information

You can correct any inaccurate information about you. To provide quality service, it is essential that your information is accurate and complete. We rely on you to help maintain the quality of the information we hold by informing us of any changes. To make a request, refer to the procedure described in section 5.4 above.

6. SECURITY MEASURES

6.1. Limited Retention

We retain your information, in digital format, only as long as necessary to fulfill the purposes for which it was collected or as required or permitted by law. The purpose, nature, and sensitivity of the information are considered in determining retention periods.

Ekosystem and its subsidiaries are subject to various legal obligations regarding the retention of personal information (for example, tax laws). In general, to meet these obligations, personal information such as your name, title, email, and sector will be retained for the duration of your relationship with us and for seven years after it ends. Additionally, we will retain transactional information for seven years after it has been executed.

Certain exceptions may apply, requiring longer retention periods, such as in the case of disputes or claims. In such cases, your information may be retained for up to ten years. When your information is no longer needed, we strive to securely destroy it.

6.2. Retention Locations

Ekosystem, its subsidiaries, service providers, and other third parties to whom your information is communicated under this Privacy Policy may conduct activities outside of France, Quebec, and Canada. Therefore, your information may be used and stored securely in other provinces and countries. In some cases, your information may be subject to foreign laws and access rights of authorities, including those in the United States.

6.3. Information Security Program

We make significant efforts to protect your information from loss, theft, unauthorized access, use, or disclosure, as well as other violations of its security. We have implemented a security program to continuously address evolving security threats. The measures adopted in our security program include:

  • Limiting access to your information. Only employees who need to view your information in the course of their work are granted access.

  • Managing passwords and setting up firewalls.

You also play a role in protecting your information. We encourage you never to share your passwords, codes, and identification numbers. Our employees do not have this information and will never ask you for it. Avoid sending sensitive information through email.

7. CHANGES TO THE POLICY

We may modify this Privacy Policy as needed. We will notify you via a notice on our websites and through other appropriate means to reach you.
